Springfern Pty Ltd (“Springfern”, “us” or “we”) is committed to protecting our customers’ (“you”) Personal Information in accordance with the Privacy Act 1988 (Cth) (“Privacy Act”). “Personal Information” under the Privacy Act includes any information by which a person's identity is apparent or can be reasonably ascertained.

This Privacy Policy sets out the manner in which we may collect, use, store and disclose Personal Information about you (“your Personal Information”)and describes how you may access and amend your Personal Information held by us.

1. COLLECTION

1.1 We will collect your Personal Information when you register with us to access the products and services available through the Springfern Website (“Products” and “Services”) and/or subscribe to our mailing list.

1.2 The Personal Information that we will collect from you usually will include your name, address, telephone number, facsimile number and email address. We may collect additional Personal Information from you if it is necessary to provide you with products and services available through the Springfern Website (“Products” and “Services”).

2. USE AND DISCLOSURE

2.1 We will use and disclose your Personal Information for the purposes of;
(a) providing you with the Products and Services; and
(b) providing you with details of the Products and Services through our mailing list; and
(c) providing you with details of other products or services (whether supplied by Springfern or another person).

2.2 If you do not wish to subscribe to our mailing list any longer and wish to be removed please contact our Privacy Officer using the contact details set out in clause 5.

2.3 We will not disclose your Personal Information to any third party, other than to organisations specifically engaged by us to assist us with providing you with the Products and Services or as required by law or who provide other products and services that Springfern would like to bring to your attention. For example, we may disclose your Personal Information to law enforcement agencies, government agencies, courts or external advisers where permitted or required by law.

2.4 If we provide your Personal Information to a third party under clause 2.3 we will, unless prevented by law or a court order, require the third party to protect your Personal Information in accordance with the Privacy Act.

2.5 We may disclose Personal Information to avoid an imminent threat to a person's life or to public safety or in other circumstances permitted by law.

3. INFORMATION SECURITY

3.1 We require our employees to perform their duties in a manner that is consistent with our responsibilities under the Privacy Act.

3.2 We will take all reasonable steps to ensure that paper and electronic records/data containing your Personal Information are stored securely in our offices or secure record management facilities.

4. ACCESS AND AMENDMENT

4.1 If you wish to access your Personal Information, then you may contact our Privacy Officer and request that this be done. Access will be made available to the extent required by law. In the interests of your privacy we may require you to verify in writing your identity prior to releasing your Personal Information to you. Any questions you may have in relation to accessing Personal Information should be addressed to our Privacy Officer.

4.2 We may impose a fee for the reasonable cost of the retrieving your Personal Information.

4.3 If you notify us that your Personal Information is not accurate, complete and up-to-date, we will either amend it accordingly or will record, on your Personal Information, the details of your notification to us under this clause 4.3.

4.4 We will take steps to destroy or de-identify your Personal Information if it is no longer required for the purposes contained in clause 2.
